Frequently Asked Questions
What is Personal Injury
Negligence is the core of most personal injury lawsuits. As personal injury lawyers, our first job is to identify who is responsible and determine how their negligence caused your injuries.
Negligence is defined as failing to fulfill a duty to another person. Negligence doesn’t necessarily mean that someone intentionally meant to harm you. Even if someone doesn’t take reasonable steps to ensure that their actions don’t endanger, injure, or cause damage to you, then that person has committed negligence. With Motor Vehicle Accidents, this often involves determining who was at fault, and what action or inaction led to the collision. This is determining liability. Liability determines who is legally liable for any damages resulting from an accident. Simply put, who is at fault. Sometimes, both parties can be partially at fault. And you can still make a legal claim for injuries sustained, even if you were partially at fault for the accident.
When should you contact a lawyer?
Speaking to an expert as soon as possible after your injury is recommended. The evidence and facts of the accident must be gathered promptly so our legal team can begin working on your case immediately.
In some cases, the individuals involved in the accident cannot advise legal counsel. This may be due to the severity of the injury, death, or age of the individuals involved. In these circumstances, our legal team will work with the person who holds legal authority over the individuals involved in private affairs, such as a person named in a power of attorney, an executor or a guardian.
Contact our personal injury lawyers in Edmonton at Moustarah & Company before you talk to any insurance company or any of the parties related to your accident. When you interact with the insurance company, anything you say can be used against you; your lawyer should handle all communication with the other party’s insurance company.
Expedient personal injury legal advice
Obtaining legal advice soon after an accident is crucial. The insurance adjuster will take detailed notes of all conversations from the first time you contact them. It is recommended that you speak to one of our injury lawyers as soon as possible after your accident. We can gather all the necessary evidence and facts about your accident and ensure that everything the insurance company hears is in your best interest. The insurance company’s goal is to minimize your payout, and anything they write down may not be in your favor. Providing information to the adjuster before consulting with us could negatively impact your claim. You want a personal injury lawyer at your side who understands the legal system in Canada when it comes to motor vehicle accidents (MVA) or wrongful acts that have resulted in injury or loss for you or a loved one. We can provide you with free advice to help you protect your rights in the long term. As your lawyers, we will guide you through the process from beginning to end.

The most common question is, “How much will I receive?” This is determined by a number of factors including, but not limited to, the seriousness of your injuries, the time it takes to recover, case law in Alberta for similar injuries, the impression made on the insurance company or the court about your pain and suffering, and the number of your expenses arising from the accident. We have extensive experience dealing with these issues and will work for you to ensure that you are fairly compensated.
If you’re looking for a formula to calculate the value of your personal injury claim in Alberta; no formula exists in Alberta. At Fault vs No Fault Personal Injury Law
The Alberta Government is changing the insurance rules and regulations in Alberta. This will change from the current at fault insurance system where the person who is negligent in their driving is held responsible and found at fault. Victims with personal injury claims have legal avenues available to fight for fair compensation and for medical treatment. Moustarah & Company has helped many accident victims get the compensation they deserve from the insurance companies. The Alberta Government is completely changing the auto insurance in Alberta. Alberta will be switching to a No Fault auto insurance, where bad drivers are not held responsible for their negligence or their bad actions. The Alberta government has announced plans to implement significant changes to its auto insurance system, transitioning to a predominantly no-fault model. The exact details are still emerging and we do not all of the information yet. However, we know that under the new no-fault insurance model, compensation for injuries from a Motor Vehicle Accident will be determined by your own insurance company. Your insurance company will determine what medical treatment you are allowed, and how much money they want to give you in compensation for your pain and suffering and lost work. Victims will generally not be able to file a personal injury claim against at-fault drivers; unless the at-fault driver is convicted of a criminal offense for the car accident. Common criminal offenses resulting from car accidents are dangerous (stunting) driving or impaired driving, under the influence of drugs or alcohol. Except in these very limited circumstances, you will no longer have any legal avenues available to you to fight for fair compensation for your injuries. Many Albertans with serious injuries will risk being under compensated at the mercy of the insurance company and they will be left will fewer legal options.
During the transition, the Alberta Government has also allowed auto insurance companies to raise rates. While the system transitions, insurers are permitted to increase premiums for “good drivers” by up to 7.5% annually. These rate increases are going to impact every Albertan who will pay more for auto insurance.
